Terms of Service
These Terms govern your use of profitmapsai.com and the ProfitMaps AI software and materials (together, the “Product”), supplied by Nicely Media LLC. By buying or using the Product, you agree to these Terms.
Your licence
On purchase, you receive a personal, non-exclusive, non-transferable licence to use the Product for your own business or for clients you serve, within the limits of the plan and upgrades you bought — for example, the number of businesses, keywords and websites. You may not resell, sublicense, rent, share or redistribute the Product itself, or make your login available to others.
White-label features let you put your own name and logo on reports and client deliverables. They do not give you the right to resell the software.
Your account
You are responsible for keeping your login details secure and for everything that happens under your account. Tell us promptly if you believe your account has been accessed without your permission.
Scan credits
Scans use credits on every plan. One credit covers one map point, so a 5×5 scan uses 25 credits and a 7×7 scan uses 49. Credits are used when a scan starts, including recurring scans you schedule. When your credits run out, you can buy more or connect your own data key.
Credits have no cash value. They are tied to your account and cannot be transferred or exchanged for money.
Your own data key
If you connect your own account with the map-data provider (required for grids larger than 9×9), your scans run on that account. That provider’s terms and charges apply, you are responsible for any costs on that account, and we are not responsible for its availability, pricing or limits.
“Unlimited” and fair use
Where a plan is described as unlimited, there is no fixed cap on businesses, keywords or websites, and Business Finder searches are subject to fair use. Fair use means normal use by a person or agency serving their own clients. We may limit automated, abusive or excessive use that affects the service for others. Scans still use credits.
Your outreach
The Product helps you find local businesses and start conversations with them. When you contact a business — by email, phone, text or social message — you are responsible for following the laws that apply to you, including anti-spam, telemarketing and privacy rules such as CAN-SPAM, the TCPA, GDPR and PECR where relevant. Honour opt-out requests promptly.
Sample websites and reports
You may build a sample website or report for a business you hope to work with, to show privately to that business. Do not publish a sample website as if it were the business’s official site, or present yourself as acting for a business, without its permission. Remove any sample when the business asks you to. You are responsible for the names, logos, photos, claims and other content you use.
Acceptable use
You agree not to use the Product to:
- Send unsolicited bulk email or messages, or contact anyone who has asked not to hear from you.
- Publish content that is unlawful, defamatory, deceptive, infringing, or that you have no right to publish — including fake reviews or misleading claims about a business.
- Promise a business a guaranteed ranking, or suggest that you are affiliated with, endorsed by or acting for Google.
- Resell, bulk-export or redistribute the map data or business listings the Product shows, other than in reports and deliverables for your own clients and prospects.
- Attempt to reverse-engineer, copy, resell or circumvent the software, its credits or its limits.
- Interfere with the service, or with anyone else’s use of it.
We may suspend or end access for serious or repeated breaches of this section.
Your content
Content you create, import or publish using the Product — including the reports and websites you build for clients — remains yours. You are responsible for it, for having the rights to use it, and for making sure it complies with the laws that apply to you, including publishing, advertising, privacy and anti-spam laws.
AI-generated content
The Product writes action plans, posts, articles and website copy automatically. Generated output may contain errors or inaccuracies, so treat it as a starting point: check the facts and add the details only the business knows. You are responsible for reviewing anything you publish or send. We make no warranty that generated content is accurate, original, or suitable for any particular purpose.
Rankings and map data
A scan shows how a business appeared in third-party map data at each grid point, at the time of the scan. Rankings change often and depend on many factors that no one controls. We do not guarantee that scan data is complete or exact, and we do not guarantee any ranking, traffic or result for you or your clients.
ProfitMaps AI is not affiliated with, endorsed by or sponsored by Google. Google, Google Maps and Google Business Profile are trademarks of Google LLC. The Product does not post to a Business Profile for you: Google posts are written for you or the business owner to paste in.
Our intellectual property
The Product, this website, and all text, graphics, video and structure within them are protected by copyright and other laws and remain the property of Nicely Media LLC and its licensors. Nothing in these Terms transfers that ownership to you.
Payment
Each plan is sold for a one-time payment at the price shown at checkout; there is no monthly fee for the plan you buy. Upgrades and extra credits are sold separately. JVZoo acts as the retailer for the transaction and their terms also apply to your purchase. Prices and promotional offers may change at any time; the price you paid is the price that applies to your purchase.
Refunds
Purchases are covered by our 30-day money-back guarantee, set out in full in our Refund Policy.
No guarantee of results
We make no promise of income, earnings, rankings or results. Please read our Disclaimer, which forms part of these Terms.
Availability
We aim to keep the service available and reliable, but we do not guarantee uninterrupted access. Maintenance, updates, and factors outside our control — including outages at the map-data, AI and hosting providers we rely on — can all cause downtime.
Limitation of liability
To the fullest extent permitted by law, the Product is provided “as is” without warranties of any kind, and Nicely Media LLC is not liable for indirect, incidental, special or consequential losses, or for lost profits, revenue, clients or data. Where liability cannot be excluded, it is limited to the amount you paid for the Product.
Nothing in these Terms limits any right you have that cannot be limited under the law that applies to you.
Third-party services
The Product relies on and connects to third-party services, such as the map-data provider, AI providers, email senders and integrations. Those services are governed by their own terms, and we are not responsible for them.
Termination
You may stop using the Product at any time. We may suspend or end your licence if you materially breach these Terms.
Changes to these Terms
We may update these Terms. Continuing to use the Product after an update means you accept the revised Terms.
